The Staff Attorney is responsible for reviewing client contracts and ensuring appropriate terms and conditions are negotiated and incorporated; managing project related disputes and claims, interfacing with Business Units and other company divisions to provide day-to day legal advice and counsel in multiple areas of the law, including but not limited to, construction, subcontracts, commercial, business, collective bargaining claims, employment and labor, and insurance; managing the litigation of assigned cases; provide training to project managers on employment matters, risk miti! gation, company policies and other assignments, as necessary. !
Essential Functions:
- Actively supports the Companyâs commitment to safety and its âCore Values.â
- Represents the Company at all times with high moral standards while adhering to the Companyâs âCode of Business Conduct and Ethicsâ and the Rules of Professional Conduct.
- Understands, negotiates, and modifies construction contracts; ensures appropriate terms and conditions, risk factors and insurance requirements are within company standards and guidelines;
- Drafts correspondence to Clients, Subcontractors, and Vendors as necessary to protect companyâs interests and promote problem resolution.
- Works closely with OU and Project Managers to ensure proper understanding of contract provisions and optimum field management of projects;
- Ensures managers are properly educated, trained and adhere to established Contract Review and Proposal guidelines;
- Under the supervision of the Sr. Director,! Legal and Risk Management, manages and works with outside counsel on litigation matters. Strategizes with outside counsel to determine the best and most cost-effective ways to litigate the given case. Manages costs of litigation and claims. Attends hearings, mediations and arbitrations as company representative. Manages and communicates with experts. Prepares litigation reports to management on assigned cases.
- Support operations with dispute resolution of significant payment or damage claims.
- Follows department policy and complete company initiatives;
- Provides legal advice on labor and employment matters, including collective bargaining, employee benefits/ERISA, OSHA, NLRB, unemployment and workersâ compensation, WARN Act, civil rights, and overall state and federal compliance.
- Responds to day-to-day employee relations and personnel issues and provide guidance and recommendations for problem resolution.
- Assists in review and d! evelopment of company employment and labor policies, procedures and pro! grams.
- Assists with investigations and gather information for issues relating to Human Resources and Safety;
- Maintains thorough understanding of companyâs insurance programs to ensure appropriate issues addressed in contracts and subcontracts, as well as, the effect of those policies on assigned cases and projects; and
- Performs additional responsibilities, as needed or requested.
- Juris Doctorate Degree from an ABA accredited law school; Bachelorâs Degree in Business, Construction, Human Resources, Safety, or other related field;
- 5+ years legal experience, with an emphasis in construction law, general corporate law and contract administration preferred;
- License to practice law, in good standing, in Pennsylvania and New Jersey preferred;
- Ability to work independently, yet part of a Team, where internal customers and other Team members office out of various remote locations! ;
- Strong analytical skills, with the ability to gather and weigh facts and information from many sources, draw conclusions and make recommendations to management;
- Demonstrated ability to work effectively with individuals at all organizational levels, both internally and externally;
- Ability to assess business risk in varying situations and make associated recommendations to minimize overall risk to the company;
- Strong written and oral communication skills as required to interface with customers and subcontractors;
- Ability to work on/manage multiple priorities simultaneously, work with frequent interruptions and meet established deadlines; and
- Proficient computer skills, including experience with Microsoft Word, Excel, Outlook, Acrobat and the internet.
Overtime and occasional travel may be required in this position.
